The IRS will still evaluate the form and any information you send with it
to see if your position is correct.

Default Form SS-8 and IRS determination

Does anyone have experience with filing an SS-8 when the company in
question is defunct? Without a response from the "employer," what is
your opinion as to the position the IRS would take?
