I would guess because Madoff's investors' losses are due
to illegal activity on Madoff's part, whereas most of "everyone"
else's losses are due to their investment choices.

On the other hand, arguably, Wexler's proposal is premature,
at least based on my rationalization. So far, I believe Madoff's
malfeasance is merely an allegation, not proven in court.
