If by "second payer" you mean a second health insurance policy, then they
are correct. You can not have any other health plan (some exceptions apply
though).

Probably Section 223.
There are also several Regulations and Rulings in this area that give more
guidance.

Default Health Savings Account and Second Payer Health Plan

I'm told by my HR that if I have a second payer with my company health
plan, that I cannot participate in a High deductible health Plan nor
make a before tax (tax free) contribution to a health Savings Plan,
and that this is an IRS rule.

Anyone aware of this and can point me to the applicable IRS code
section?
