That sounds like a business expense. He's in the business of being an
employee. (In a different case, a loan to an employer went bad and
was deductible as a business bad debt, for that reason.)

Employee leaving one company has to get legal help on separation
agreement to get rid of the non-compete clause so he can get a job
with competitor in the same area. Which was successful I might add.
Can these legal costs be deducted?
