If given the option must would opt to receive a W-2 and have the employer
pay 1/2 the employment taxes rather than paying the entire amount oneself.

Whether or not one is an employee who gets a W2 and an independent
contractor who gets a 1099 depends on facts and circumstances, not
personal preferences. More likely than not, the situation you
describe is one of an employee.

Default Question on 1099

My wife is working part time - per diem (as a nurse) in a hospital.
She works there a couple of days a week. We want to get 1099. Hospital
says they have no issue.
My question is that I have never dealt with 1099. What is the process?
How do we get a 1099 and not W2
appreciate any answers
Thanks
Jim
