| I moved from Delaware to Texas in Oct. '05, it was a permanent move. Delaware has state income tax, Texas does not. I claimed Delaware residence for 10 months of '05 on my tax forms and all parties was OK with that. In Feb. of '06 I discovered my employer still had my address listed as Delaware, I changed it to Texas. During the first 2 months of '06 I paid $450 income tax to Delaware. When I filled my '06 taxes I claimed 12 months TX residency to reclaim the $450. Delaware amended my tax return and only remitted $40. When I called Delaware the agent told me they go by the W2, I would have to show them a W2 with 12 months TX residency before I'm entitled to the remaining $410. I spoke to an IRS agent who informed me it is a requirement of my employer to make corrections on my W2 using the W2C form, but my employer's payroll department refuses to do this. Their stance is, "too bad about your money, you should of checked your address". What would be my next step?
