I hope the contract stated the painting contractor carries and provides his own workers comp? Otherwise, if he is injured on your property there is a chance he can sue you and collect. __ Art Kamlet ArtKamlet [at] AOL.com Columbus OH K2PZH << ================================================== ===== > << The foregoing was not intended or written to be used, > << nor can it used, for the purpose of avoiding penalties > << that may be imposed upon the taxpayer. > << > << The Charter and the Guidelines for submitting posts > << to this newsgroup as well as our anti-spamming policy > << are at www.asktax.org. > << Copyright (2006) - All rights reserved. > << ================================================== ===== > |

You do not need to provide a 1099. Your contract for> Painting, a licensed painting contractor and > sole proprietorship, to paint my personal > residence. They operate a business, and you are their customer. It is their responsibility to report their income, and you have no obligation beyond paying the invoice for services or goods rendered. | I hired and signed a contract with ABC Painting, a licensed painting contractor and sole proprietorship, to paint my personal residence. Later, we signed an amendment to the contract pursuant to which payments due under the painting contract are to be made directly to the sole proprietor. In other words, no checks payable to ABC Painting, all checks payable to Mr. Proprietor. Aggregate amount is $3,000. Am I correct that since I am not conducting a trade or business, I do not need to file a 1099 If I do need to file a 1099, is a 1099-MISC or ? And should the 1099 show ABC Painting or Mr. Proprietor as the Recipient? Thank you.
