If you contracted for painting for your own personal use and
not in connection with any business, then you have no need
to file a 1099.

I hope the contract stated the painting contractor carries
and provides his own workers comp? Otherwise, if he is
injured on your property there is a chance he can sue you
and collect.

Not only don't you need to, but you shouldn't.

You do not need to provide a 1099. Your contract for
painting your house is really no different than paying a
plumber for installing a sink or an appliance dealer for
delivering and installing a new washer and dryer. They
operate a business, and you are their customer. It is their
responsibility to report their income, and you have no
obligation beyond paying the invoice for services or goods
rendered.

I hired and signed a contract with ABC Painting, a licensed
painting contractor and sole proprietorship, to paint my
personal residence. Later, we signed an amendment to the
contract pursuant to which payments due under the painting
contract are to be made directly to the sole proprietor. In
other words, no checks payable to ABC Painting, all checks
payable to Mr. Proprietor. Aggregate amount is $3,000.

Am I correct that since I am not conducting a trade or
business, I do not need to file a 1099

If I do need to file a 1099, is a 1099-MISC or ? And should
the 1099 show ABC Painting or Mr. Proprietor as the
