Be aware, also, that if a correction, amendment, or audit of
a late filed refund return determines you owed tax, you will
be penalized for late filing, up to 25% of the unpaid tax,
and you will be charged interest from the original due date
of the return. You should file within the extension period
to avoid any failure to file penalty.

There used to be a provision for a further extension,
however with the new six months automatic extension these
days, "generally" (IRS words) they may not grant you
further time unless you're out of the country.

Also be aware that "in general" (my phrase) you have three
years to file for a refund. And although any tax
professional on this board should advise you to go ahead and
file by Oct 15th, if truth be told, IRS probably won't
notice that you haven't filed on time.

There are no extensions to FILE available, beyond October
15. There are NO extensions of time to PAY beyond April 17,
2006, so if you owe when you get around to filing you will
be subject to penalty and interest.

Default Delayed tax filling

I filled for extension for the 2005 tax filling which will
give me till October 15.

Was divorced in August 2005. I had bought a home in
November 2005. . My reason for filling for extension was to
allow time for an Innocent Spouse Relief I had done against
a $2000= underpayment of tax in year 2004 when my fraudulent
ex-wife filed on line jointly on our behalf in my absence as
I had changed state of residence, made spurious claims
leading to IRS audit. A similar IRS demand for tax year 2003
for $1500 was automatically docked from her 2005 refund,
filling single and divorced.

Now I have been unemployed since August 2006. If I file my
tax now, the joint debt for which my innocent spouse relief
has not been agreed nor rejected will be taken from my
refunds. Since I have been paying PAYE tax for all of 2005
up till this August, I believe I will not owe IRS anyback
tax, and indeed will have some refund.

Can I request a further extension on the 2005 tax filling?
Besides the stiff interest penalties on past taxes due to
IRS beyond the granted extension time, can I skip filling
till next April when I shall file for 2005 and 2006?

Can someone advise me if my intent has no illegal
interpretation.?
