Actually, if your total gross income from all sources meets the filing requirements, and you have CA source income, you are legally required to file a return even if you have no tax liability. However, there is no penalty for failing to file if no tax is due. Two days doesn't seem like enough to generate a tax, or if it does, it is probably so small that it wouldn't justify the state's cost to process a return. Of course if your total salary is very high, you could have a significant liability. | I live in TX but worked 2 days in CA in 2005. According to CA, I need to pay CA state income tax. Am I legally required to file and pay this? What are the consequences to me if I don't file and pay?
