for assistance at 1-800-829-1040. When you call, have the
following information handy: ..."

The IRS person that takes your call will just tell you to
file Form 4852.

You still must file your tax return on time even if you do
not receive your Form W-2. If you cannot get a W-2 by the
tax-filing deadline, you may use Form 4852, Substitute for
Form W-2, Wage and Tax Statement, but it will delay any
refund due while the information is verified.

If you receive a corrected W-2 after your return is filed
and the information it contains does not match the income or
withheld tax that you reported on your return, you must file
an amended return on Form 1040X, Amended U.S. Individual
Income Tax Return.

Forms 4852 and 1040X and their instructions are available on
the IRS Web site, IRS.gov or by calling 1-800-TAX-FORM
(1-800-829-3676).

You need form 4852 from the IRS. This is a substitute W-2
and is usually used when you have tried your best to get a
w-2 from your employer but have not been able to. Make
sure you read the instructions for form 4852. Some states
(for example, California) also have a state substitute W-2.

You can use Form 4852, Substitute for Form W-2, Wage and Tax
Statement, available from the IRS at
http://www.irs.gov/formspubs/lists/0,,id=97817,00.html -
just scroll down until you find Form 4852.

You will use the Year-To-Date (YTD) information from your
last pay stub for the year to fill out the Form 4852.

You can use the paystub info to in effect make a replacement
W-2.

Default W2 never sent - Company of previous employment not to be found

I stopped working for a company about 7 months ago (end of
August 2005). I had been working as an intern and been
being paid my hourly wage though a "temp" agency. It is now
March of 2006 and I have yet to my W2 form from the temp
company that had been paying my salary.

What I have done thus far about this:

1. Called / attempted to contact the company listed on my
pay stub
- My pay stub is no longer current - the company is no
longer located at the address listed

2. Called the company I had been working directly for to see
if they had the temp agencies current information
- The company I had been working for no longer does business
with this temp agency
- The most current information they have is a P.O. Box and
know that the company's name had been changed as of about 4
months ago (I attempted to get a phone number but the person
in charge of dealing with the temp agencies insisted she
didn't have it and that it was not in her records ~ which I
find hard to believe).

3. Attempted to locate the company under the current name &
have had no success in doing so.

What is are the next actions I should take? Do i need to
take any?

I believe I have my latest pay stub which lists my earnings
and tax deductions... can this information be used to file
my taxes or do I need the W2 to do so?
