| Tell your friend to NOT pay any money to the former employer. He can claim the wages they paid him on his income tax return by using the Year-To-Date (YTD) information on the last check or pay stub he received to fill out Form 4852, Substitute for Form W-2, available at http://www.irs.gov/formspubs/lists/0,,id=97817,00.html. Simply fill out the form and attach it to his tax return. Lacking this info, he should do his best to _estimate_ total earned, and report it as part of a timely filing of his return. Assuming IRS is successful, and he receives the overdue W-2, he can file an amendment 1040X. There is a FAQ at www.irs.gov, which offers further specific suggestions on this matter, and you might want to read that. Try entering "W-2 not received" in the search option. | My friend was an H1 employee for a consulting company from Jan to March '05, after which he transferred his H1 and is a full time employee with a large company now. His previous employer now refuses to issue a W2 to him and asks for $2000 in order to get it. He reported to the IRS and they would be sending a certified letter to the employer requesting the W2. If they fail to issue it, they would have to pay a fine of $50. How can he pay taxes without W2? Also, will he have to file them on his gross income during that period? Please help!
