If it's not required, as in this case of personal
transactions, I will never advise a client to do so, as it
just clogs up IRS machinery. In fact I will do whatever I
can to dissuade anybody from so doing.

if you are a trade or business that made the payment (over
$600), you are required to file the Form 1099-MISC.

There is no requirement if you are NOT a trade or busines,
however, that doesn't stop you from filing the 1099-MISC
with the IRS if you want to.

Don't need no ideas when the law is clear. And that is just
as you outline it above; 1099's required ONLY if in the
course of a trade or business.

Yes. It is not.

1099's are routinely required only for some payments in the
course of a trade or business. If you tell us what
instruction is confusing you, perhaps we can debunk it for
you.

Does anyone know whether it is necessary to file a 1099-Misc
for contractors who fix personal residences? The 1099-Misc
Instructions seem to say that it is only required if it is
paid by a trade or business; however, other sections of the
instructions seem to negate that? Any ideas?
