You should have sent in at least that Quarters accrued taxes, regardless of prior quarters missed From this day forward you will be in FULL COMPLIANCE or you will never resolve your tax problems. As a further gesture of good faith might consider actually making your 4/17/2006 estimated tax deposits now VIA EFTPS if you are a participant, or mail to Service Center/lock box, make a copy of that check & ES COUPON to substantiate your action, include it with the Amended OIC. I suggest that you attach the actual return with original signature to the amended OIC. Clearly indicate that the return requires Processing & Assessment, once the examiner reviews it and makes a copy of the OIC investigation file, the return will be sent to the appropriate Processing center for assessment. One Day At A Time, from this day forward you MUST BE IN CURRENT COMPLIANCE. << ================================================== ===== > << The foregoing is intended for educational purposes only > << and does NOT constitute legal OR professional advice. > << > << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org. > << Copyright (2006) - All rights reserved. > << ================================================== ===== > |

| I originally filed my OIC for tax years through 2004, with the intention of amending it for 2005 once I filed my 2005 return, since I owe for 2005 as well. One of the things the IRS noted in its letter to me last month requesting more information was that I need to be current on estimated tax payments. But those would be for 2005, which I'm planning on including in my OIC once I file it. My amended OIC is due by this Friday, and I plan to list 2005 in the amended OIC, to alleviate any issue with estimated tax payments for 2005. Do I need to have the return filed before I send the amended OIC, or is it enough to just list it, with a note that I will be filing the 2005 return shortly? Thanks for any advice.
