Echoing Gene: There is a reciprocal agreement between VA> have to file a MD state tax return, a VA state tax return, > or both? and MD whereby a resident of one state, working in the other, pays tax only to the state of residence, as long as the only income sourced in the other state is compensation for services. If you have other VA source income, you must file a VA return. Your employer should have withheld MD tax from your wages. If VA tax was withheld, you will need to file a VA return to get a refund. Assuming all you have is W-2 income, you ONLY file a> have to file a MD state tax return, a VA state tax return, > or both? Maryland tax return. Maryland, Virginia, West Virginia, Pennsylvania & DC have a reciprocal tax agreement in place - this is unique in the tax world - whereby if you live in one jurisdiction and work in the other AND YOU ONLY INCOME IN YOUR NONRESIDENT JURISDICTION IS W-2 INCOME, then you only file in your state of residence.
