The only person who knows the answer to your question is"you." An F-1 student files the 8843 in order to document how and why they are exempt from the substantial presence test. Normally, the exemption ends after you are present in any part of five years. However, there are exceptions to the 5 year rule. See page 7 of IRA Pub 519, US Tax Guide for Aliens for the exceptions. | I have been in USA for 12 years as a international student under F-1 status, and I have never worked, no income, and I have never filed any tax or any sort of documents, so now, Do I really have to file Form 8843 or any form for tax purpose? and I am thinking about applying for a green card through relative later, would this( not filing tax because I have no income) negatively afftect my petition for naturalization (meanning getting a green card)?? thanks!
