It doesn't matter that you get no benefit from the dependency exemption. << ================================================== ===== > << The foregoing is intended for educational purposes only > << and does NOT constitute legal OR professional advice. > << > << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org. > << Copyright (2006) - All rights reserved. > << ================================================== ===== > |

| My 9 year old grand-daughter lives with me and my boyfriend. He supports both of us and I do not work. Can he claim her as a qualifying relative? We've been told that since I have legal custody of her, she would be considered my qualifying child and only I can claim her as a dependent. What doesn't seem quite right is that I am not a taxpayer for this past year because I have not worked and my boyfriend has supported both of us for the past year, and it seems that he should be able to claim my grand-daughter as a relative dependent based on the fact of support and residency AND the fact that she is nor being claimed as a dependent on anyone elses tax return.
