Only one person can claim EIC, and I would think it would be
you based on what you say.

There is just too little information to know.

Well, don't go to that H&R person, because they are wrong.

Or better yet, go to them and when they say they can't,
threaten to sue them (and use the words "BIG TIME" in as
loud a voice as possible.)

You only have three years to claim a refund. This time has
passed. If you file for 2001 the IRS will keep your refund.

You can file amended tax return(Form 1040 ATR), Only one
taxpayer can claim for Kid as EIC. Forms does not matter in
this regard, you can file either depending on your status.
1040ez, 1040a, or 1040

Unless that relative was your child's grandparent it is
highly likely that your child could not have been the
qualifying child to the relative for purposes of the EIC. In
2001, the child would have had to be a son, daughter,
stepchild, foster child, adopted child, grandchild, brother,
sister, stepbrother or stepsister. The last 4 relatives
would have also required that the relative treat the child
as if the child was their own child.

All of the above is probably moot anyway as 2001 is a closed
year for refunds. Any refund for 2001 should have been
filed by 4/15/05.

You'll pay interest going back to the original due date,
plus failure to file and failure to pay penalties. At this
late date, the P&I will likely far exceed the balance due.

You're not going to get a refund for 2001 no matter what you
do. The statute of limitations for a refund claim expired on
15 April 2005.

I'm sorry to tell you, there's no good news here;

1) There are strict tests to take the credit, a child may
not be used more than once for the EIC.
2) you said it's the 2001 return. The deadline for getting a
refund based on that return was 4/15/2005 or three years
after the return was due. The return is still due, and if
you owe anything, interest and penalties have been
accruing.
3) I'm sorry H&R said otherwise. In this day and age, it's
easy to find the information you need, I try to include a
reference in my posts to back up my reply. A Google of EIC
IRS, led me to pub 596, the IRS document regarding the EIC;
http://www.irs.gov/pub/irs-pdf/p596.pdf
4) Lastly, if you always get a refund, depending how large
it is you may want to recalculate your withholdings. You'd
be better off upping your 401(k) deduction or other savings,
and not lending the government money interest free.

Last date to file an amended return for a refund for 2001
was 4/15/2005. Too late now no matter what.

Default 2001 EIC help

Me and my son lived with a relative in for the full year of
2001. i paid half the rent, food, etc. both of our names
were on the lease. They claimed him for the eic and already
received the credit, but I also provided at least half of
the support and I made less then $20,000 that year, what
will happen when I submit my 2001 taxes? I've yet to do
this.

I believe I claimed 3 exemptions on my w-2 for that year. I
always get a refund, but I dont know now that someone else
has claimed him. What if I owe? How harsh with the
penalties and fines be? Will I be able to avoid owing if
file a different form, 1040ez or 1040. I always have filed
1040a.

Is there a way to still receive a refund?
