| Over the past 13 years, I have taken only a handful of penalty abatement cases because the vast majority of them are losers. It is impossible to answer your question because you haven't cited "reasonable cause" which MUST be present in order for the IRS to abate penalties. I recently took a flight for a meeting with a client and an Appeals Officer. Frankly, I didn't expect to win the penalty appeal despite the client having a pretty severe gambling problem. In fact, the client offered me a percentage of the penalty returned to him (which is entirely legal), but I turned it down. The meeting took about an hour and you guessed it. We got five years of late filing penalties abated resulting in about $53,000 refunded to the client (he had already paid the amount in full). I guess I should have taken the percentage deal. In any event, please post the specifics of why you believe the penalties should be abated and we can give you better assistance with more information. In chronological fashion, explain the circumstances that contributed to the tax delinquency. refrain from going back to the day you were born, I've seen a few of those! If a tax return was filed late, explain why. If an estimated tax deposits was not remitted when due, explain why. If multiple years of these events occurred, explain why. Demonstrate, your understanding of the requirements, cite examples of your current compliance with these requirements, that you are making estimated deposits, FTD deposits.
