If filing joint with your new husband (assume you weremarried before the end of 2005), your income is combined with his to determine your filing threshhold. If filing single (not married in 2005) or separate, you may not NEED to file, except to get back the $37 withheld on your W-2. Assuming your husband has income, it's probable that MFJ will be preferred, so your information will be combined with your husband's. But in any event, you should file -- because you had taxes withheld on your W-2 ... and also, because the 1099MISC will have to be treated as "self-employment" income, which means you will owe SS and Medicare taxes. - quote - > Here's the info from my W-2:

Yes, you should file -- but in concert with your husband.If you don't file MFJ, then you both have to agree on how to file MFS (since if one of you itemizes, the other must also). Now, if by some chance your remarriage took place after the end of 2005, then you will still have to file -- because of the WH tax plus the 1099MISC earnings. - quote - > I'm completely dumb in this department.
