You haven't given a sufficient amount of information to
determine whether you need to file or not. Your total
income isn't given (1099 + W-2 income), your husband's
income isn't given (this presumes that your husband works).
If you're married, most commonly you'd file a joint return
w/ your husband (although not required).

Yes, that is income too. How much was it?

Not taxable.

If filing joint with your new husband (assume you were
married before the end of 2005), your income is combined
with his to determine your filing threshhold. If filing
single (not married in 2005) or separate, you may not NEED
to file, except to get back the $37 withheld on your W-2. In
other words, not nearly enough information provided to give
you a definitive answer.

Let's start here. If you've remarried as of Dec. 31, 2005,
you should be filing as Married -- either filing jointly or
separately -- and the two of you should be seeking guidance
together. Assuming your husband has income, it's probable
that MFJ will be preferred, so your information will be
combined with your husband's. But in any event, you should
file -- because you had taxes withheld on your W-2 ... and
also, because the 1099MISC will have to be treated as
"self-employment" income, which means you will owe SS and
Medicare taxes.

Of course. As noted above, you'll be assessed for SS and
Medicare (roughly 15% of your 1099 earnings). That will be
calculated from a Schedule C and the corresponding Schedule
SE -- which will be filed in your name, as a part of the
joint return.

Child support is not taxable.

Yes, you should file -- but in concert with your husband.
If you don't file MFJ, then you both have to agree on how to
file MFS (since if one of you itemizes, the other must
also).

Now, if by some chance your remarriage took place after the
end of 2005, then you will still have to file -- because of
the WH tax plus the 1099MISC earnings.

Default Can someone tell me if I need to file or not...please?

I haven't filed in many years, ever since my first husband
in the 90's. I haven't really worked either, stay at home
mom.

I'm currently re-married,I have 2 kids (from 1st marr.) and about 4
months ago I had a temp. job. To begin with they didn't take out taxes and
they recently sent me a 1099. Then they started taking out taxes and a
week ago I rec'd a W-2.

I am no longer employed there.
Here's the info from my W-2:

Wages $1464
S.S wages $1464
Medicare wages and tips $1464

Fed. Income tax withheld $36.93
S.S withheld $90.77
Medicare $21.23

Do you need the 1099 info too?
