Well, Northern California is not in the "same general area"
as Southern California. I think the same general area
should be considered as being in the same commuting range
and not requiring a change in place of abode.

Paul, you should read the OP again. He says he was laid off
from the first job, but not from the second. I don't
believe the involuntary separation exception applies to the
second move.

Wish I could. However, northern California is not the same
"general area" as southern California.

On the other side of the coin, moving expenses to the new
general area start the clock running. anew.

It sounds like it would qualify. One of the exceptions to
the 39 weeks is getting laid off. or "involuntary
separation" for other than willfull misconduct. (hope you
were a good boy).

Default Regarding Form 3903 Moving Expense

I am a bit confused with the time test on the form 3903. I
was laid off from my job in end of Feb 2005 from Maryland.
I moved myself (costing over $5000) to Southern California.
I worked there for 16 weeks and switched jobs to a company
in Northern California. Can I claim $ 5000 as moving
expense. The form says one must work 39 weeks in the
general area of new job. What is general area? Same state
considered general area? How to interpret it. Also I was
laid off from my first job not second. Since I paid over
5K, I would really like to claim it as it can save me some ?

Please help !
