No. You use the max allowable less the $5,000.

No.

You get to use up all 5000 and no more if you have one
dependent and claim no additional credit. If you had two
dependents, you can claim a total of 6000, 5000 + 1000 of
the additional payments.

You must file Form 2441 and enter the 5000 on the top line
of Page 2 of that form.

We have Flexible spending account for dependent and we maxed
out to $5000, but our expense is $9000, does rest of money
i.e. $4000, use for dependent care credit?
