Unless the company deals in inventory-related or other "hot
asset" items. Then the gain will be ordinary.

Otherwise, LT capital gain is correct.

Long-term gain.

Default Disposition of Passive Investment

I have an opportunity to investment in a company which I will
not be actively nor materially participating. Assuming this
is my only passive activity and I hold it for more than one
year, the losses will only be allowed to be deducted when I
disposed of this investment. If I disposed of this investment
at a net gain will this be a long term capital gain or ordinary
income?

Your time and advice are greatly appreciated.
