I think you would qualify for the credit if both you and
your wife have earned income. You can only get the credit
if you fill out the proper forms with the required
information.

I once had a client whose wife had a business which incurred
a loss, so they could not get the credit although both
worked--but her income was negative, hence, no child care
credit.

If your kid isn't old enough that school is compulsory under
state law, and the reason your child is in the program is to
allow you and your spouse to work, it should be eligible for
the Child Care Credit. If your kid is old enough that
school is compulsory, only expenses for before and/or after
care are eligible.

For example, my daughter is likely to start preschool in the
fall, which will replace her current (non-preschool) child
care arrangement. Tuition for the school day is ~$6k, and
for extended day is ~7.5k. Since she's not old enough to
have to go to school, the whole $7.5k is eligible for the
credit (subject to the cap, of course, which makes the
distinction between 5k and 7.5k moot).

Oklahoma requires full-time education for kids who are over
5 and under 18, and half-time education for kids who are
over 4. So for the school year starting after she turns 5,
only the premium for extended day of $1.5k plus summer camp
tuition of ~2.5k would be eligible for the credit (and the
cap again makes it moot).

They audited you and disallowed the credit, or you called
the TAX-1040 number and the person you talked to said they
thought it wouldn't fly?

You said the kid was in preschool so your wife could work.

Does this mean the preschool didn't help you go to work? If
so, the expense is not allowed.

The preschool should be providing day care services so both
of you can work or go to school.

On form 2441, the Day Care expenses should be the smallest
figure of a) day care, b) Your earned income and c) your
wife's earned income.

If that wasn't indicated that way on the 2441, then this
might explain why it was bounced. Otherwise read very
carefully what the IRS notice said, and if you do not
understand it, contact the IRS and speak with someone who
can explain it to you.

Yes, it is eligible.

Expenses for first grade or higher are not eligible.
