| Depends on when you received the initial request from the IRS for your 2000 return. You have 2 years from the date of payment to request a refund or you can sue for any payments up to 3 years prior to the date of the IRS request for your return. As far as the IRS not accepting certified mail receipts - I've never heard anything like that. | The IRS had requested an older tax return, saying they had not received it (year 2000), though I had sent it in on time. (I had overpaid 2000 by over $1,000., and applied this to 2001.) Since they said they had no record of 2000 being received, I sent them a copy of my return. But now they're saying it is past the date to apply any refund to 2001, and they are just keeping the overpayment - they will not apply it to anything! Is there any recourse to this? Can they just keep this money? No refund? No reimbursement? No application of funds to 2001? Nothing? I really just want to apply this amount to 2001, since it had taxes to pay, and not applying it means they will be charging penalties, etc.. Is there nothing I can do to get the money back? I did not intend to just give the IRS a gift, so how can they just keep this amount of money without applying it somewhere or giving it back? They also don't accept Certified Mail receipts as proof of mailing any longer, so what the heck can any of us do if THEY lost our tax return records and we only have the copy of the return we sent in as proof? Can they really just keep all of the money I sent in???! Please help if you can.
