The late filing penalty is based on the unpaid tax as of the> there is no additional tax due? due date, so there's no immediate penalty. | Is there a penalty for late (4 months) filed returned when there is no additional tax due? My mother in law is filing late, but has already over-paid taxes via 1040ES and will be getting a refund. Would there be a penalty in this case? If so, what percentage?
