The late filing penalty is based on the unpaid tax as of the
due date, so there's no immediate penalty. If a deficiency
is assessed some day, a 20% penalty would apply when the
original return was 4 months late.

Penalties are based on the tax due; if none then no penalty can be
assessed.

Default Late fileing 2004 1040

Is there a penalty for late (4 months) filed returned when
there is no additional tax due?

My mother in law is filing late, but has already over-paid
taxes via 1040ES and will be getting a refund.

Would there be a penalty in this case? If so, what percentage?
