If likely net income, then read the thing about perjury
above your signature on 1040!

You can sue yourself for anything -- in LLC law in my state,
you're likely responsible to timely file the 1065 if the
other guy won't. You can't sue him for your own taxes, and
suing to get the guy to do something may not work well if
the argeement that he would do the 1065 was oral. Of
course, an attorney can still send threatening letters
suggesting otherwise. But your partner can then just give
you the records, and give you one week to do his K-1! IOW,
you two will have to work things out.

File Form 4868 for extension to 8/15. Can you estimate the
net income, like from the amounts paid to you as
distributions from the LLC? You should do that to see if
money needs paid with 4868 to avoid a .5% per month penalty.
If not large amounts involved here, you can even file your
1040 with an estimate on Sch E. Then amend your 1040 later
when a K-1 surfaces.

Default Form 1065 Not Reported

I had a LLC business last year with two members. The
business went into a standstill after doing some business
for few months. I have not received form 1065 - K1 from my
partner. Can i file my taxes without the 1065 form? If I
file without the 1065 form but then later receive the 1065,
can I hold the partne liable for any differences in my tax
returns. Will I have to file amended 1040 after I receive
the 1065?
