As an aside, the treaty provides an exemption to students from the savings clause. In other words, if you were a resident for tax purposes, you could still avail yourself of the $5000 exclusion as long as you were still in the same status and conformed to the treaty article for students (Article 20). -- Alan http://taxtopics.net << -------------------------------------------------> << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org > << -------------------------------------------------> |

| I am an F-1 student from China. I have been advised to choose to be an alien for the tax purpose. By that way my first $5000 income is exempted from the US tax. My question is whether I can choose to be a US resident? This is the fourth year I am in the US. I will have to be a US resident from the next year for the tax purpose anyway. What's the other consequencies on my future such as my application for a green card if the answer is yes and I choose so?
