I assume you are referring to the 10% early withdrawal
penalty. Assuming that the funds in the plan did not come
from another type plan via a rollover (i.e., the plan assets
are Section 457 deferred compensation) there is no 10%
penalty for early withdrawal as a 457 plan is not a
qualified retirement plan.

I'm in school. I took out all my contributions to a 457
plan. Do I have to pay penalties? Can't I offset the early
withdrawal by my tuition expenses, like for an IRA?
