For example in NY an LLC must use LLC at the end of the name. There should no "legal" issues, if you mean will you be> xyz company as direct employee, can I work for this small > business along with my spouse?. violating any laws. However, your present employer would not be happy if your small business was competing in any way with the business of your present employer, or using any equipment or other resources of your present employer or interfering with the work your present employer is paying you to do. If I were you I would tell your present employer about your plans to start this business and make sure they do not see any conflict of interest.
