First, you state that your husband "also works F/T 'outside> that my husband does from home (he also > works F/T outside the home and received W4 > for that job). ? Can we deduct expenses > related to his work from home ( which equals > 5-10 hours per week): i.e internet, cell phone? the home' and received W4 for that job" -- which I am going to assume should have read "W-2." The referent for "that job" is also unclear, but I'm going to assume you meant a "different" job -- from an employer other than the one who issued the 1099 Misc. Given those assumptions, your husband should file a Schedule C -- or a Schedule C-EZ (if expenses are less than $5,000) -- and it is on that form that he should report the income received for his part-time _Self Employment_ (as reported on the 1099-Misc). Either form will allow you to deduct expenses incurred for the production of the income, and internet and cell phone charges which were directly related could be included. But don't forget that if the internet connection was also used for personal E-Mail, etc., that only a percentage of the ISP charges should be applied to the business expense. Use of either C or C-EZ will lead to an entry on Schedule SE, for self-employment tax -- which is the 15.3% of income which is usually shared by an employer, and the employee's share is reported on a W-2. The SE will also lead to entries on the back of the 1040 (for additional tax due) and on the front (for an adjustment to income deduction equal to 1/2 of the SE tax). If my assumptions are wrong and your husband performed the part-time work for the same employer as his full-time job, there's a whole different set of entries as a part of Schedule A, but that's another question. Yes. Income from the 1099-MISC usually goes on Schedule C> does from home (he also works F/T outside the home and > received W4 for that job). ? Can we deduct expenses related > to his work from home ( which equals 5-10 hours per week): > i.e internet, cell phone? and you can also deduct related business expenses on that same form. He will also need to pay self-employment taxes using Schedule SE if the 1099 income was $400 or more. As I read the instructions, the 1099-MISC work must be "regular" instead of "sporadic" but those terms do not seem to be well defined by the IRS. -- Vic Roberts Replace xxx with vdr in e-mail address. << -------------------------------------------------> << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org > << -------------------------------------------------> |
