| Here is the update: We went through all of my wife's returns since she moved from TX to CA. I immediately focused on the '00 return which listed her CA address, but showed no state taxes withheld. She got confirmation from her employer (the TX-> CA move was corporate) that her official CA residency started Jan 2001, so there should be no CA tax for '00. (Confirmed W-2 was complete and correct) Armed with this new info, We finally got someone on the phone from the CA tax office and they said thank-you, this issue is closed - and they could not get my wife off the phone fast enough apparently. I would prefer to have this in writing - How I can get this issue resolved in writing so I have a record to show? Extored, exhonerated in RWC. All the ones I have seen had years and amounts on them. That being said, it is obvious that the FTB has your wife in its gunsights. If there are any unfiled returns or outstanding tax liabilities that you know about, you should take care of them as soon as you can. If you don't, and the FTB catches up with you after the amnesty period has expired, you will owe not only the tax, interest and penalties that were already applicable, but also a new "amnesty" penalty equal to 50% of the interest otherwise due on the outstanding amount. You would probably be wise to consult a local practitioner who is familiar with the amnesty program. Even if you are not aware of an outstanding return or liability, there may be something that you haven't thought of, and a discussion with a knowledgeable practitioner could help suss that out. It's not really enough to say, well, I don't owe them anything, so I don't need to do anything. If the FTB comes along later and finds something you were totally unaware of, they will still sock you with the 50% interest penalty. There are efforts to amend the statute to limit the application of that penalty, but no guarantee they will be successful. Good luck!
