If he paid it out of his own funds, yes. If it was paid
from the IRA, then no, he can't claim it.

Did he pay it separately or was it a reduction in the
proceeds?

Client was charged a $6,300.00 surrender charge for
liquidating his annuity upon a trustee to trustee transfer
of his IRA.

Would this qualify as a miscellaneous itemized deduction
subject to 2% AGI?
