employer is wrong and you are right. And this goes for
non-electronically filed returns, too.

I doubt the employees need to do anything. But, keep better
than good records this year.

What should happen is the employer would file corrected
payroll reports with the IRS and SSA (including corrected
W-2's showing $0 wages paid under the bad number), and then
submit payroll tax reports under the correct number,
including W-2's that report the wages paid under the correct
EIN number.

Let's hope the employer isn't in the business of giving tax
advice.

No. If (big IF) the return is rejected, you'll fix it then,
but not with an amended return. If the e-file isn't
rejected, you have no problem.

Employer changed structure during 2004, formed new
corporation, obtained new EIN. Employer issued W-2's in
January, but now discovers the old EIN is on the W-2; says
they will be issuing corrected W-2's shortly to all
employees. Employer says if employees already filed 1040,
they need to file 1040X to amend return. There are no
dollar changes on the W-2, the only change is the EIN.

If employees have electronically filed 1040 with the wrong
EIN, is employer correct advising employees to file amended
return to correct this? I don't even see a place on the
1040X to do this, it's designed for changes in income,
deductions, etc.
