With the facts you provide, I strongly suspect your husband
filed correctly, i.e. "married filing separately", and of
course listed your name and social security number as
mandated.

Then, when you tried to file incorrectly as "single",
that's what kicked your return back to you, since IRS, NOT
Social security administration, was already on notice that
you are indeed married.

You have two choices. You can file electronically
correctly, i.e. married filling separately, or you may
file the old fashioned way, via a paper return.

You should by now be aware that when two people are married,
neither can file as "single."

For once....I agree with Block. He has to amend his return.
If you wish to file jointly, you cannot file
electronically. If you do not wish to file jointly, he
cannot file an amended return electronically, and well I'm
not sure why you cannot.

Your husband should not have done that. As a married
person, he is not allowed to file "Single". He needs to
amend his return.

Same deal. Since you are married, you can't file as Single.

Is there some reason why you two didn't just file one return
together as "Married Filing Jointly"?

Since you are married, you have two choices:
* File one return together as "Married Filing Jointly"
* Each file your own return, where you each have a
status of "Married Filing Separately".

Generally the former is significantly more advantageous than
the latter. But in any event, "Single" is not an option for
either of you.

Even if you had left your name alone you still could not
legally use "Single" as your filing status.

Right, because you're trying to file an incorrect return.

You can file a correct return. That means that if you
cannot or will not file one return together with your
husband, you need to do your return as "Married Filing
Separately."

That's correct. If your husband cannot or will not file a
return together with you, he needs to amend his return to be
"Married Filing Separately" instead of "Single".

Alternatively, he can amend his return to include all your
income/expenses and change the filing status to "Married
Filing Jointly" (and then you do not file a return on your
own).

Well, that's too bad for him. He still has to amend his
return so that it's legal. And if that means he has to pay
money back to the IRS, that's what has to happen.

You should proceed by filing a correct return. So you
either file your own return as "Married Filing Separately"
or you go in together with your husband on one "Married
Filing Jointly" return.

Your husband needs to amend his return to include you and
your income - or he amends his return to file
married-separate and you file married-separate. Usually
filing a joint return results in a lower tax. Single is
never an option for married taxpayers. If the amendment is
filed before April 15, there should be no interest or
penalties attached.

Default Ammending my tax return---please help

While preparing his taxes my husband filed his return as
"single". When I received my W-2 I proceed to file my
taxes. I attempted to file as Single. However, I've
officially corrected my name with the social security office
so my married name is associated with my 9-digits. Thus I
was unable to use single as my "filing status". The IRS is
refusing to let me file my claim electronically. I don't
want to mail in my claim forms, soley because I don't want
to wait, is there anything that I can do or submit that
would allow me to file electronically? I spoke to an HR
Block rep, who said my husband needed to "ammend" his
return, however he's already received his Federal
Return-cashed it--and spent it...how should I proceed???
And will this affect my return??? Please any help will be
greatly appreciated.
