Then, when you tried to file incorrectly as "single", that's what kicked your return back to you, since IRS, NOT Social security administration, was already on notice that you are indeed married. You have two choices. You can file electronically correctly, i.e. married filling separately, or you may file the old fashioned way, via a paper return. You should by now be aware that when two people are married, neither can file as "single." If you do not wish to file jointly, he cannot file an amended return electronically, and well I'm not sure why you cannot. -- David M. That's correct. If your husband cannot or will not file a> "ammend" his return, return together with you, he needs to amend his return to be "Married Filing Separately" instead of "Single". You should proceed by filing a correct return. Single is never an option for married taxpayers.
