Thanks for the responses. Much appreciated. I filed a 1988
tax return, however I no longer have a copy of it. I
received a Consolidated Statement of Tax Liabilities for
interest and penalties for tax years 1988, 1989 and 1995.
The assessments for 1989 and 1995 were closed, as the amount
was to small for them to pursue. However the assessment for
1988 still stands and was assessed for underpayment of
estimated tax. I figure it wil cost me as much, or more than
$800 to search this out, than to just pay it and make it go
away, If I received an assessment before, I am not aware of
it. I've had 4 different CPA's in the last 15 years, and it
could have slipped by one of them, or me.

One of my clients recently received a similar notice for her
1992 NY taxes, and of course also had no record of the
return. The local NY tax office was extremely helpful. They
had a record of the dates they had previously mailed the
notices to her (annually since 1994), and had a transcript
of her original 1992 return. They didn't have a transcript
of the 1994 "audit" which resulted in an underpayment
determination, but the underpayment matched exactly with the
scenario that he had made a common error - using his Federal
itemized deductions directly for NY without subtracting the
NY tax.

There is a statute of limitations for assessments. But if an
assessment was made years ago, the collection on it could
possibly still be open.

You should bring this notice to your own CPA/tax advisor for
appropriate action on this matter

Yes, there is a statute of limitations for years in which
you filed New York State income tax return. If you did not
file, the statute never started, so it never runs out.

Paying this one is unlikely to have any effect on future
years. However, you shouldn't pay it without knowing what
the issue was and whether the assessment is timely and
correct.

Was what you received a billing for taxes due, or a notice
of a proposed assessment? Did you file a 1988 return?
