Hmmmm 2000, very close to statute! I hesitate to have him do
the following, here goes:

If he in the process of filing several returns 2000 to 2003
inclusive, and there are more balances due.

Then

Have him write a letter to accompany the unendorsed refund
check. He should ask to have the refund reposted to 2000,
then the resulting credit balance transferred to 2001, and
he could carry the entire balance through, to the last
period where he may have a liability, and even further
forward to 2004 as an estimated carry forward.

Note the date value of the funds carried forward is the
original or extended due date of the source period.

example
TY-2000 overpayments will carry forward as 4/15/2001 $$$
TY-2001 " 4/15/2002 "
TY-2002 " 4/15/2003 "
TY-2003 " 4/15/2004 "

Assuming here he hasn't even filed his 2001 return, yet. If
he had, and also had a refund from 2000, "THEIRS" would
have kept it.

As far as I know, each year stands on it's own, unless he
had specified on the 2000 return to apply overpayment to
next year's estimated taxes. If so, AND they sent refund,
they would have been at error, and an abatement of interest
might be feasible.

I have done that in the past, if I recall correctly, when I
or the IRS made a mistake regarding how much was to be
refunded to me and how much was to be applied to the next
years estimated. I just sent in a letter with the returned
check.

Are you sure this refund check was for 2000? Some how I
don't think so. I say this because the year 2000 is a
closed year and most of the time no refund will be coming at
this time. In most cases, if a taxpayer owes money for
another year, IRS will just keep that portion of a refund to
take care of the shortfall.

He owes about half of that (before penalties and
interest) on his 2001 return.

He wanted to know how to go about returning the check to
the IRS to avoid the penalties and interest.
