Her possessions were 1) a life estate in a house that was quit claimed to my husband and his brother about 15 years ago. 2) miscellaneous articles whose value does not exceed 2 thousand dollars. She passed away two weeks ago. The plenary guardian is petitioning for release. The lawyer who worked for the plenary guardian is petitioning that her fees, a few thousand dollars, were not paid to her and that a lien be placed against the estate.... My question is: Since the life estate ended with the death of my mother-in-law, can any claim be made against the house? Neither my husband or his brother wants to become involved in any way with executorship or probate. Since the estate is only miscellaneous articles, and neither cares to inherit any of it, what happens as far as TAXES, executorship , or administration of probate. The guardian will be bailing out before any of this can happen. Who files the tax returns ?
