Did I say an SS-5 form above?

Slip of the wrist I assure you, but NOT necessarily from
bending my elbow at happy hour.

To avoid giving her SSN to customers.

The EIN, IF NEEDED, is requested using form SS-4. Sole
proprietors, without employees, can use their own SSN as
their tax number.

Just for the record, "her" business income and expense will
appear on "Her" tax return. I say that because she had the
option of filing a separate return, but may file jointly, in
which case the her income and expenses will appear on
"their" 1040.

And these days, with no children in household, MFS is
looking pretty attractive in some cases.

One added point if a corporation, and that is she will still
complete the W9 form to attest to the fact it IS a
corporation and thereby give the payor notice that he is
absolved from the 1099-misc requirement.

She should file it under her name ans SS# unless her
business has an EIN of its own. Assuming she has not
incorporated her business, the income and expense will
appear on your 1040.

Tell her to file under the "legal entity" she operates as.

Does your wife have an EIN number for the business.
Does your wife file tax returns for the business.
If not use her name. If so use the business name and #.

Unless she has a separate federal Id number for the business
(FEI #, which takes the form xx-xxxxxxx) then she uses her
(real) name and social security number.

If she has a choice, it don't really make a difference.

Either way, she would use her social security number unless
she operates the business as a corporation. Only in that
case she would use the corporation's tax ID number.

Note: If she operates as a corporation, the payer isn't
required to issue a 1099 form. Having "Inc." or "corp." in
the name would clarify that for the payer.

Does your wife have an Employer Identification Number for
her business? It would look like this 00-0000000. If she
doesn't have one you may download tthe form SS-5 from
www.irs.gov and mail it in. When she gets it she may use
the EIN instead of her SS#.

Possibly both. I received a W-9 from a plumber for work
done on a rental property which has both the DBA name, and
the owner's name and Social Security Number.

Her name on line 1, the d/b/a on line 2. See the W-9
instructions.

Default w-9 form and a small business

My wife did kind of a freelance graphic design job and has
to comeplete a w-9 form for tax purposes. She asked me
today if she should file under her own name or under her
graphic design business name. What should I tell her?
