Its been introduced in Congress several times in recent
years, but has not yet passed.

A similar health insurance instrument called Health Saving
Accounts has this provision. Employers may offer these to
employees.

No chages that I am aware of. Carefully review your
estimated expenses before making the decision to
participate. Any contributions that are not used during the
plan year may not be paid to you in cash or used in a later
plan year.

Earlier this week the Chairman of the Senate Finance
Committee asked Treasury Secretary Snow to investigate
whether his organization has the ability to rewrite the rule
without Congress having to amend the law. There have been
various proposals put forward in Congress to amend this
rule, but they have not gotten very far.

As of this moment in time, the use it or lose it rule still
exists.
