There's a few days grace granted around the filing deadline.

However, this whole "we never got your 8453" is geting to be
a real problem for the volunteer VITA and TCE/TaxAdie world.

Not that the volunteers aren't conscientious -- in my
experience they are.

But sometimes a volunteer will place all 8453s in one
envelope and all those get stapled together by the IRS and
only the top 8453 is recorded. Or because the IRS doesn't
furnish enough envelopes, a volunteer will batch a few weeks
together, thereby blwoing the time limits.

The worst part, however, is at end of the April tax season,
all client files have to be purged, and the PCs returned to
the IRS depots, so none of the volunteers have anything to
send in when a client gets a "we never got your 8453"
notice!

I've discussed this with our IRS folks, but the are part of
SPC and are not involved with the 8453 issues. It makes for
a number of unhappy taxpayers.

I haven't seen that happen in the past. That's why we use
the 8879 - PIN version, nothing to mail. The last year we
used the 8453, I sent one 5 times because IRS said they
didn't have it. The reason I remember was it had a 15 page
power of attorney!

When I got this alert and saw the usual 10 day requirement,
and realizing that we'll be gone for three weeks to Scotland
starting Wednesday, I called Memphis and acquainted the
girl with my problem. She looked it up on the computer and
said "you only have two showing, so don't worry about it
atall!"

Meaning I guess, she went ahead and marked them as "done."
We'll see when I return if there's a letter, but at least I
was assured that nothing to worry about being late.

Some parts of IRS sure have changed from "the old days".

On another case, I inquired today via our own practitioners'
hotline and got satisfaction without sending a POA. AFter
all, I explained to the gentleman, that I didnt' even have a
fax machine.

Seems that when you check the box bottom of the form (1040,
1120, etc) that authorization is good for 12 months from due
date of return. It's not JUST for IRS to call you.

Now there's a change I really , really like.

We (and several CPAs in our area) have gotten erroneous
"Send in your 8453" notices for PIN-signed decedent returns
when the decedent was the first-named taxpayer. If you call
the e-file help desk, they'll manually mark the record as
not needing an 8453.

I just learned that on the first two returns I filed for 2003, while I meant
to file a paperless return, I actually did not. So they are now asking for
the late forms 8453.

This checking all the right boxes on the software, and only
all the right boxes is getting more tiresome with each
passing year.

Both returns were for my daughters so at least if I can't
find or don't have 8453's I can get them easily.

As a requirement of the IRS e-file program, an Authorized
IRS e-file Provider is required to submit Forms 8453, U.S.
Individual Income Tax Declaration for an IRS e-file Return,
to Internal Revenue Service within three business days after
receiving acknowledgement of return acceptance. An
electronically submitted return is not considered filed
until we receive a complete and signed Form 8453. IRS
Submission Processing Campuses are sending Letter 2759
requesting that you submit the Forms 8453 listed within ten
days. When a PIN signature method was accepted by Internal
