Just to clarify here, regardless of how things happened, the
excess is 2003 income and must be reported as wages on the
2003 return, amended if necessary. If the excess was
returned on or before 4/15/2004, it is taxable only in 2003.
If the excess is returned after 4/15/2004 it is taxable in
both 2003 and 2004. In both cases a 2004 1099-R will be
issued, but the coding will indicate whether it's taxable or
not.

If you were notified by March 15, 2004 you could have
amended or filed your 2003 return and added the disallowed
HCE amount to your Form 1040 Line 7 wages. You can still
amend if you didn't do this. If they notified you after
March 15, they will issue you a Form 1099-R by January 31
2005 which you will include on your 2004 tax return.

IIRC, you get a 1099-R for the excess contributions, not an
amended W-2.

They won't amend your W-2. Just add the amount to
your wages.

Default 401k was top heavy

I was told by my company that our 401k was top heavy and
that the contributions are invalid but so far I haven't
received a revised W-2 from my company. Should I amend my
return and just add back the 401k contrubtions to wages or
is it necessary that I receive an amended W-2?
