| My employer offers employees the ability to contribute to a cafeteria plan. Regardless of if I add any additional amount, it appears that the company pays me my salary + cost of health care -- which is immediately put into the cafeteria plan so I am just taxed on my salary. I opted to withold an additional $0 per pay check per month for a total contribution of $0 for 2004; that was signed late 2003. I got married on May 13, 2004. I then modified my W-2 tax witholdings as well as submitted a cafeteria plan modification for $4000 to cover the costs of my wife's health care and medical expenses for us both. My question (finally) - Can I submit medical bills for the cafeteria plan to reimburse for: a) me prior to date of marriage ? b) my spouse prior to date of marriage ? Is it the date of marriage that is important or the date the cafeteria plan was updated? I would imagine that the effective date of change would be the date of change in status. Any IRS Pubs you can refer me to would be great as well!
