Does it make a difference if the employer > pays them in cash? 1) Look for another job. 2) No 3) No You are an employee of the cafe because it's difficult to be an independent contractor (IC) when the services must be performed on the employer's property and according to his/her schedule. The employer may try to convince you that you are better off as an IC but he is the one who is better off. He saves on his half of Social Security taxes. He is avoiding worker's compensation payments (If you get hurt on the job, you will have little recourse against the employer.), and he isn't paying unemployment taxes. Once you have found another job, report him to your state's Department of Labor.
