Would section 461 (h) apply here since the tuition is only
due if the person completes enrollment in 2003? If
enrollment is not completed, the entire amount would be
refunded.

Also, the school did not receive the payment until January.
I don't remember what the postmark was.

The school received the check in January, 2003. I don't
remember what the postmark (posted date) was.

Does that matter? If they received the check in January,
can I use it for the 2003 tuition deduction?

On what date did you actually deliver the check?

Not on your 2003 return, but you may be able to take
advantage of it on an amended 2002 return. See Publication
970.
