When you file and show much more income yourself and that the home for 2003 was yours, that his return is wrong will be very clear. Will anything happen to him, probably not because his tax is zero anyway and the taxman has better things to do. Have you two ever considered using a tax preparation professional? Respectfully, it looks like you could be money ahead by just filing correctly in the best way. "Head of Household" requires that he supply over 50% of the upkeep of a "household" for at least 6 months, and have someone else living there who would be a dependent but for "children of divorced parents" considerations.
