The year in which you do not sell capital assets for a net
gain.

Under current tax law, the capital gains rate of 5% for
taxpayers in the 10% and 15% ordinary tax brackets will go
to zero in 2008. The 15% CG tax rate remains the same. This
also holds true for qualified dividends for those same
taxpayers. In 2009, the whole shebang reverts back to the
law as it existed in 2002. No qualified dividends and CG
rates of 10% and 20%.
