They were advised it was not a tax issue, but they might have a cause of action, if the company is still in business (and has any assets). For which, you should consult an attorney. I believe they were further advised that they could report the offending company to their state wage and hour enforcement division, as well as to the IRS -- presuming some "phantom taxes" were withheld from the "phantom income."
