This is not really a tax question. Would recommend posting
to misc.legal.moderated and including whether being tried in
federal or state court and which state the case is being
tried (would assume CA, but you know what they say about
assume).

Default subpoena foreign plaintiff

Investors from Japan sent money to a real estate broker for
a California development project. The broker never prepared
a "single document" between himself and his investors or he
and the developer. The project will be sold and broker is
demanding a larger share of the profit for his investors.
The broker sued as attorney in fact on behalf of his
investors. Can developer require the physical appearance of
investors to take their depositions.
