First, never go by what another person said, or what another> months. Im not sure if my pay was from Workers Comp or my > employer, but it was included in my W-2. You need simply to ask your employer as to the source and that will guide you. Sounds like it was from a disability policy that your employer paid for. but you won't know till you ask. It all depends. Payments received from worker's> months. Im not sure if my pay was from Workers Comp or my > employer, but it was included in my W-2. Payments you receive from a disability plan in which you paid the premiums would also not be taxable and you would not receive a W-2. Payments made under an employer's benefit plan which you did not pay for in after-tax dollars (typically called sickness & accident benefits) would be taxable as compensation and included on a W-2. -- Alan http://taxtopics.net << -------------------------------------------------> << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org > << -------------------------------------------------> |

| I was injured on the job and was out of work for a few months. Im not sure if my pay was from Workers Comp or my employer, but it was included in my W-2. I was told by a co-worker, who was injured last year, that his accountant told him that pay was not taxable and cited case law. He cannot find last years filings and cant remember the case cited. Any ideas?
