.....However, remember that most of the fraudulent EIC filed
returns are e-filed. Granted that doesn't necessarily affect
the state(s), but it could be an indication that with
e-filing comes [more] tax fraud, where such is typically NOT
done under the paper system.

Well, you can try--but it may be an uphill battle. In
reality California is not the worst--in Oklahoma, preparing
a mere 50 returns will dump you into the forced efile
category. Michigan and Wisconsin also have implemented
required efiling for professionals.

I'll put it this way--I didn't see that as one of Arnold's
key issues <grin> . Reality is that for most individuals
this isn't their problem--if their preparer is required to
efile, well so be it. Since the legislature provided that
the individual can opt out, any taxpayers that really object
to the concept have a fix, which means only the preparer
community is going to be opposed. And there's not enough of
us to pose a realistic threat to the elected officials--but
the monetary savings they see in their budget can be used in
ways that can buy larger blocks of votes.

I suspect we'll see virtually every state go this route over
the next few years.

Much as I am vehemently against mandatory efiling, I also
think fighting it is probably futile. Its a battle you can
only lose. While the IRS probably won't be able to mandate
(read blackmail) us into efiling, they are doing it through
the back door - the states.

As a result of recent state budget shortfalls (real,
imagined, perceived or whatever) the states are passing
their administrative functions, along with related costs
onto us. I am involved in the NJSCPA and currently am on a
task force to try and deal with the issues here in NJ. The
state is completely deaf to the administrative burden. But
they might be willing to listen to a liability type of
perspective. From what I hear informally, NJ will implement
mandatory efiling in the next few years. That is the one
thing that they seem to be perfectly clear about.

Are there any groups that are taking action to repeal or
change the 2004 new California law that forces taxpayers to
E-File or sign a form that sits in the preparer's file?
This is a hardship to the taxpayer and the tax
prepaer/business. If there is no group, how can one get
started as a grass roots movement against California
Assembly Bill 1756?
